With No Reform, Penalties for Marijuana Possession Still Heavy in Texas

Each year in Texas, more than 70,000 people are arrested for marijuana, and the vast majority of those arrests - 97 percent - are for possession of 2 ounces or less. In fact, marijuana arrests make up more than half of all drug arrests in Texas.

Those numbers are particularly unsettling when you consider that, so far, 19 states and Washington, D.C., have made possession of marijuana in small amounts no longer a crime. In Texas, though, possessing less than 2 ounces of marijuana is still a misdemeanor punishable by up to 180 days in jail, plus a maximum fine of $2,000. Depending on the amount of marijuana in question, a felony conviction in Texas could result in a prison sentence ranging from 180 days to 99 years. 

Even if you're convicted of a low-level marijuana offense, you can still face negative consequences beyond jail time and a fine.

Employers and landlords routinely conduct background checks, and when a marijuana conviction shows up, it can be detrimental to a person's efforts to find employment and housing. Additionally, anyone convicted of a marijuana misdemeanor in Texas faces driver's license suspension.

A student's academic career can also be negatively affected by a marijuana conviction. For example, if you're a student at one of San Antonio's many universities or colleges, then a marijuana conviction could mean that you lose your financial aid, even if you were in possession of only a small amount of cannabis.
