Transport of Marijuana into Texas More Likely as More States Approve Legalization

Voters in four more states recently approved legalization of recreational marijuana, and voters in five other states recently approved medical marijuana.

In Texas, however, recreational marijuana remains illegal, and access to medical cannabis is extremely limited under the Texas Compassionate Use Act.

Will Texas pass meaningful marijuana law reform in the upcoming legislative session?

The next legislative session starts in January. Texas, unlike other states, does not allow cities and counties to create and enact their own marijuana policies. The change has to come from the state legislature.

The National Organization for the Reform of Marijuana Laws (NORML), along with many veterans and everyday people in favor of legalization, are urging lawmakers to take action in 2017.

Will other states' approval of legalization affect the laws in Texas?

It remains unclear whether Texas legislators will be swayed by increasing legalization in other states, although there is some evidence suggesting that lawmakers' attitudes have softened on the matter in recent years.

One thing that is clear: as other states legalize marijuana, there is a greater likelihood that people will be transporting various marijuana products -- including leaf marijuana and THC extracts, dabs and oils -- across state lines and into Texas.

If you find yourself facing drug charges in connection with any form of marijuana, it is important that you have on your side a criminal defense lawyer who understands the issues and is willing to fight for your rights and freedom.

At Hoelscher Gebbia PLLC, we are committed advocates for marijuana law reform, and for years we have been fighting for decriminalization of marijuana one case at a time. To learn more, please see our overview of possession of marijuana in Texas.
