College students and DWIs: Know what you are up against

Legal issues can be a real hindrance for anyone -- regardless of their age or occupation. However, college students facing criminal charges often find themselves in unique spots after an arrest, as they can end up with not only criminal consequences, but also educational ones. A conviction can also negatively affect future employment opportunities, which is a rather tough issue to deal with when preparing to start the rest of your life outside of college.

In Texas, like all states, there are very specific laws when it comes to drunk driving. For those 21 and older, the legal driving limit is .08. How many drinks it takes to reach this limit is different for everyone and depends on factors such as a person's weight, whether someone is drinking on an empty stomach and just how an individual's body processes alcohol.

For those under the age of 21 -- which is the case for many college students -- the legal driving limit is zero. This means that any amount of alcohol detected in the system could result in criminal consequences. Depending on the college someone attends, there could also be disciplinary proceedings instituted by the school. Add to this the fact that some employers want to know about all criminal convictions, and suddenly a one-time mistake is continuing to haunt someone who was just getting ready to start their adult life.

What to do after a DUI/DWI arrest?

Whether someone is under 21 or over 21, the first step after a drunk driving arrest should be to call an attorney.

The truth is that an arrest does not need to mean a conviction. For example, if the results of the breath test were inconclusive, the results could be thrown out. Or, if let's say the arresting officer made a mistake, either by pulling the driver over without having reasonable suspicion to do so -- or violated the protocols for arrest -- these are all circumstances that could be used to challenge the state's accusations.
